The difference between an “young padawan”* and his “Master”
Young padawan:
“Dear sirs,
We had received a mail from our tenant in Unit 2 that is complaining about:
- violation of the space (2 persons broke the seal he installed on the door – according to security company personnel)
- the poor quality of the works (eg: the new fire resistant door is scratched and dirty)
- unfinished works (ceiling, plinth, parquet profiles, missing door closing dampers)
Concerning the access we remind you that according to the lease contract: the Landlord is permitted in the spaces only upon a 48h notice and accompanied by a representative of the Tenant. Since this agreement was breached we are in the situation to be sued by our tenant. For this reason, please note that, we would like the persons that entered in the space and broke the seal to be fired.
Concerning the quality of the finishes we are in this moment much to used with it to complain about. Please recall the low quality of the finishes and remediation works left in Unit 1 as well (just to list few of them) – not to mention the remediation lists from all the warehouse and the annexes:
- the damaged fire resistant door from the offices to the warehouse;
- the door handles of the pedestrian access doors from outside to the warehouse;
- the threshold at the entrances in the offices from outside (the door is too high)
As for Unit 2 please fix the ones remarked below, in our tenant’s own mail.
Regarding the unfinished works please inform us which is the final - FINAL date to finish the fit-out works of this unit. I remind you that so far at least 3 terms were given by you with the solemn promise to be fulfilled – and all have failed to happen. The last one being – 1st of August (2 weeks ago!).
In the end may I remind you that we, as the Landlord representative, we paid by this date all the money that you as a constructor has claimed to us. You can not use this excuse further more to explain the site situation.
We are eager to receive your answers by the end of today.

“Dear sirs,
We had received a communication, attached below, from our tenant in Unit 2 that is complaining about:
- Unauthorized access to the Unit (2 persons broke the seal he installed on the door – according to security company personnel)
- The poor quality of the works (eg: the new fire resistant door is scratched and dirty)
- Unjustified late delivery of the Tenant improvement works (ceiling, plinth, parquet profiles, missing door closing dampers)
Notwithstanding the seriousness of this complaint, please note as follows:
Access to the Leased Premises: According to the lease contract, the Landlord and its agents are permitted to access the leased areas only with a written application submitted 48h before the time on access and accompanied by a representative of the Tenant. As you know, the current arrangement calls for you to be carrying out Tenant Improvement works only while the Tenant is in the premises and at no other time. This provision needs to be respected, and hence we repeat to you that any person found breaking this rule will be removed from site immediately without recourse. As for the members of your team that entered the Leased Areas last Friday, we request that they are identified and removed from site as soon as possible. Please notify us when this is done. In addition and to avoid further problems on this front, you will surrender all original and copies of the keys of the Leased Premises and the Master Key by tomorrow morning to me.
Quality of the Works: This is an ongoing issue that needs to be addressed at once. We have noticed a decline of the quality of the Works from the base building to the Tenant Improvements, and this is clearly unacceptable. There are still plenty of remedial works to be carried out on Unit 1 and the Base Building. Building right the first time is always cheaper. Please note that no payment will be made towards the defective/unfinished until these issues have been solved. Some examples of these are:
- the damaged fire resistant door from the offices to the warehouse;
- the door handles of the pedestrian access doors from outside to the warehouse;
- the threshold at the entrances in the offices from outside (the door is too high)
As for Unit 2 please fix the ones remarked below, in our tenant’s own mail.
Delayed Tenant Improvement Works: once more, we request that you send us your FINAL date for the completion of the Works in Unit 2. This period cannot be longer than 3 weeks from today. We remind you that so far at least 3 terms were given by you with the solemn promise to be fulfilled – and all have failed to happen. The last one being – 1st of August (2 weeks ago!).
